Alcohol Permit Information

Facility Operational and Rental Rules and Regulations for
The Serving and/or Consumption of Alcoholic Beverages for the
Welcome Center and the Whispering Pines Shelter
at the TimberRidge Adventure Center


Pursuant to Resolution No. 046-10 as adopted by the Board of County Commissioners of Johnson County, Kansas, and pursuant to Resolution No. 10-12 as adopted by the Board of Commissioners of the Johnson County Park and Recreation District, and subject and in addition to the general rental rules, policies and procedures of the Johnson County Park and Recreation District (JCPRD) applicable to the rental and use of the Welcome Center and/or the Whispering Pines Shelter at the TimberRidge Adventure Center, these  Facility Operational and Rental Rules and Regulations shall apply to the operation of the Welcome Center and the Whispering Pines Shelter at the TimberRidge Adventure Center.  

1.The serving and/or consumption, but not the sale for consumption, of the following alcoholic beverages as defined by Kansas law:  Cereal Malt Beverage (3.2% beer), Wine (including champagne), and/or Beer (5% beer) (those terms are used herein and have such meaning) at the Welcome Center and at the Whispering Pines Shelter including their respective immediate areas all as more fully shown on Exhibit A hereto:  

a.shall be allowed at one or both of such facilities in conjunction with the rental of such facility(s) by a renter for a private rental activity (herein the “renter’s activity”), and subject to a JCPRD alcohol permit being issued  to the renter  under these Facility Operational and Rental Rules and Regulations, but provided, however, that any serving of such authorized alcoholic beverages shall only be through the services of persons who are caterers or a similar designation and licensed for serving such Cereal Malt Beverage, Wine and Beer under applicable state and/or local laws, ordinances, rules and/or regulations, and who are designated on an JCPRD alcohol permit to serve such beverages;

b.shall be allowed in conjunction with an event or activity sponsored, or conducted by JCPRD at such facility(s), provided, however, that the issuance of a JCPRD alcohol permit shall not be required, and further provided, however, that any serving of such authorized alcoholic beverages shall only be through the services of persons who are caterers or  similar designation and licensed for serving such Cereal Malt Beverage, Wine and Beer under applicable state and/or local laws, ordinances, rules and/or regulations.  

2.The serving and/or consumption at the Welcome Center and at the Whispering Pines Shelter of any and all other alcoholic liquor or alcoholic beverages, except Cereal Malt Beverage, Wine and Beer is strictly prohibited

3.The serving and/or consumption of Cereal Malt Beverage, Wine and Beer is not allowed in any parking lot or on any other JCPRD property at the TimberRidge Adventure Center outside of respective designated area of the respective facility as shown on Exhibit A.  

4.Under no circumstances shall any Cereal Malt Beverage, Wine and Beer or any other alcoholic liquor or alcoholic beverage be consumed or possessed by, or given, sold, or traded to any person under twenty-one (21) years of age.  

5.The serving and/or consumption of Cereal Malt Beverage, Wine and Beer as authorized hereunder shall not be allowed after 10:00 p.m. on any day, shall not be allowed before 8:00 a.m. on any day, and shall not otherwise be allowed when the serving and/or consumption of such alcoholic beverage is otherwise prohibited by any applicable law, ordinance, rule and/or regulation, and may otherwise be further limited to the timeframe specified in the JCPRD rental agreement for the renter ‘s activity and/or further limited under the JCPRD alcohol permit issued for the renter ‘s activity.

6.In conjunction with the renter ‘s activity the JCPRD staff shall accept and review written applications on such forms and with such information to be provided from each renter as the JCPRD staff may reasonably require prior to the issuance of a JCPRD alcohol permit.   The renter shall provide accurate information and notify JCPRD staff of any changes or corrections.  All applications must be received by JCPRD staff not less than ten (10) days in advance of the scheduled renter‘s activity.    

7.Subject to the rules and regulations set forth herein, the JCPRD staff may approve and issue to a renter a JCPRD alcohol permit which would allow only the consumption of Cereal Malt Beverage, Wine and Beer for the renter‘s activity at the Welcome Center and/or the Whispering Pines Shelter.   An alcohol permit issued to a renter and permitting only the consumption of Cereal Malt Beverage, Wine and Beer shall not allow the serving of such beverages.    

8.If a renter desires to have Cereal Malt Beverage, Wine and/or Beer served for consumption during the renter‘s activity at the Welcome Center and/or the Whispering Pines Shelter, no JCPRD alcohol permit shall be issued to allow the serving of such alcoholic beverages until the JCPRD staff shall have timely received from the renter all of the following:

a.     fully completed and accurate application for the issuance of a JCPRD alcohol permit; and

b.   for each and every person who is to serve Cereal Malt Beverage, Wine and/or Beer at the renter’s event,  a copy of such person’s current state and/or local license(s) and/or permit(s) as required to serve such beverages at the renter‘s activity, and written proof of liability insurance covering such server(s) and JCPRD in such form as may be acceptable to JCPRD staff, with insurance coverage in such amounts consistent with JCPRD vendor insurance requirements, and including liquor liability insurance in an amount of not less than $1,000,000; and

c. such additional documentation as may be reasonably required by the JCPRD staff; and  

d.all such documentation must be received by JCPRD staff not less than ten (10) days in advance of the renter’s activity.

If the application and the documentation is timely received, and is thereafter approved by and in the discretion the JCPRD staff, a JCPRD alcohol permit may be issued to the renter which would authorize the serving of Wine, Beer and Cereal Malt Beverage at the renter’s activity by the caterer or similarly designated person licensed to serve such beverages and as identified on the alcohol permit application and on the JCPRD alcohol permit issued to the renter.  

9.For a JCPRD sponsored or conducted event or activity at the Welcome Center and/or the Whispering Pines Shelter where Cereal Malt Beverage, Wine and/or Beer is to be served, each and every person who is to serve such beverage at the such event or activity, shall provide a copy of such person’s current state and/or local license(s) and/or permit(s) as required to serve such beverages at such facility, and written proof of liability insurance covering such server(s) and JCPRD in such form as may be acceptable to JCPRD staff, with insurance coverage in such amounts consistent with JCPRD vendor insurance requirements, and including liquor liability insurance in an amount of not less than $1,000,000, and such additional documentation as may be reasonably required by the JCPRD staff, in advance of such event or activity.    

10.An alcohol permit issued to a person properly licensed as a caterer or a similar designation to serve Cereal Malt Beverage, Wine and/or Beer at a renter’s activity, shall only allow and permit the serving for consumption of Cereal Malt Beverage, Wine and Beer, and does NOT and shall NOT allow, permit or authorize any sale for consumption of any Cereal Malt Beverage, Wine and Beer or any other alcoholic liquor and/or other alcoholic beverage.  

11.The renter shall be responsible during the renter’s activity for the compliance by each and every person who is serving Cereal Malt Beverage, Wine and/or Beer with the JCPRD alcohol permit, these Facility Operational and Rental Rules and Regulations, and with all laws, rules and regulations applicable to persons serving and/or to the serving of such beverages.  

12.Under no circumstances shall any JCPRD employee provide, sell or serve any Cereal Malt Beverage, Wine and Beer, or any other alcoholic liquor or alcoholic beverage, to any renter or other user of the Welcome Center and/or the Whispering Pines Shelter.  

13.If any information on a renter’s application for a JCPRD alcohol permit, and/or if any information and/or documentation provided in conjunction with a renter’s application for a JCPRD alcohol permit, shall be found or reasonably believed by JCPRD staff to be false, misleading and/or inaccurate, then no JCPRD alcohol permit shall be issued if one has not yet been issued, or if a JCPRD alcohol permit has been issued then it shall be immediately revoked and notice of such revocation should be given to the renter in a reasonable manner, provided, however, the failure or delay in providing such notice to the renter shall not negate the effect of such revocation.   In addition, any violation during a renter’s activity of an issued JCPRD alcohol permit and/or of these Facility Operational and Rental Rules and Regulations, shall in the discretion of the JCPRD staff, be grounds for the immediate revocation of the issued JCPRD alcohol permit, and/or in the event of a material breach of the renter’s rental agreement with JCPRD for the rental of the Welcome Center and/or the Whispering Pines Shelter, shall in the discretion of the JCPRD staff be grounds for the immediate termination of the rental agreement including any right of the renter to continue to use the facility for the renter’s activity.
